    Important Dates

Monday, February 19, 2007
: The first day same-sex couples will be allowed to file for civil unions.
Note: This is a state holiday (President's Day) and, most likely, no licenses will be issued!

Tuesday, February 20, 2007: The last day to file a civil union license if you want to be married over the weekend.

Thursday, February 22, 2007: The first day same-sex couples will legally be allowed to have ceremonies (all applications for a
marriage or civil union in New Jersey are subject to a 72-hour waiting period) Because of the holiday on Monday, licenses applied
for on Tuesday will not be valid Thursday.

Friday, February 23, 2007: Anyone holding a ceremony over the weekend must pick up their valid licenses today -- no ceremonies
can be performed in the absence of a valid license
. This will probably be the FIRST day ceremonies can be performed due to the
holiday on Monday.

    Be well prepared for your trip to the Clerk's Office

1.        Some cities/townships require you to make an appointment for an application--    take a moment to call ahead !
Confirm the number of witnesses the municipality requires.

2.        You must follow the same procedures for a marriage license: Double-check that you have   everything you need.
Many couples overlook an item on the checklist and are turned away.

3.        Don't forget your witness(es)!

4.        
File for the license in the municipality where you LIVE.  If you live in New Jersey (the rule is:   file in the municipality where
your fiancée or fiancé  lives, or in the municipality where the fiancée  lives if the intended lives out of state;

5.        If both parties live
out of state, then you file in the municipality where the ceremony is to take place.

6.        No blood tests are required in New Jersey!

7.        
You need to provide the NAME and ADDRESS of your OFFICIANT when you apply for your
license.

    What should you bring with you, when you apply for your marriage license:

  •        A copy of your birth certificate,  drivers license, passport or state I.D.
  •        Proof of your residency.
  •        Your social security card or social security number, per
                        NJSA 37:1-17. (Social Security Numbers shall be kept confidential and may only be released for child
                        support purposes and shall not be considered a public record pursuant to P.L. 1963,  C. 73 (C.47:1A-1
                        et seq.)
  •        A witness (18 years or older) who knows both the applicants.
  •        A $28.00 fee. (Some sources say ONE others say TWO witnesses.)
                          Please Call Your Registrar's Office to be certain.
  •        If you are divorced or have had your marriage annulled, bring the
                        divorce decree or the civil annulment documents.
  •        A Death certificate, if your former spouse is deceased.

    Do not sign the marriage application form before going to the Local Registrar. You must sign the application,
    while under oath, in the presence of the issuing authority.

There is a 72 hour waiting period between the filing of the application and the issuance of the license. This 72-hour waiting
period begins at the time the application is filed with the Local Registrar.

The marriage/civil union application is valid for six months from the date accepted, unless the registrar has granted prior
approval to extend the validity of the application to a maximum of one year. Only one marriage/civil union license may be
granted from a marriage/civil union application, if the license expires prior to being used a new application must be made. The
only exception to this requirement is in the case where a civil and religious ceremony are to be performed on the same day. In
this case, photocopy the marriage/civil union application marking one “A” and one “B”, issue the corresponding marriages
licenses, marking them “A” and “B” as well.
